Trusts & Estates and Probate Litigation

Our attorneys are experienced in the areas of both sophisticated estate planning and trust and estate administration.  We have an extensive trust and estates practice, assisting clients in the planning and implementation of simple and complex estates and trusts, including wills, living trusts, irrevocable life insurance trusts, family limited partnerships and limited liability companies, qualified personal residence trusts, grantor retained annuity trusts, spousal lifetime access trusts, multi-generational planning, charitable trusts and private foundations.

We analyze estate plans with a view towards implementing your personal plan and minimizing or eliminating the federal and state estate tax, federal generation-skipping transfer tax and state inheritance tax.  We also review and recommend various estate planning techniques according to our clients' needs, including lifetime gifting, retirement benefits planning and estate protection.  As a significant number of our clients hold interests in closely held businesses, we have substantial experience in succession planning for the continuation or sale of such businesses upon the death, disability or retirement of a shareholder or partner.

Our practice also involves all areas of trust and estate administration, including the probate of wills, preparation and filing of state and federal income, gift, estate, inheritance and generation-skipping transfer tax returns, preparation and settlement of executor and trustee accounts.

Estate or probate litigation in New Jersey is conducted in the Superior Court, Law Division, Probate Part, whose Judges have developed a specialized expertise in this area of the law.  These actions most typically involve disputes alleging undue influence, duress or lack of testamentary capacity in connection with the preparation of a will or trust.  Other disputes can include holographic wills, multiple wills, omitted spouse/elective share and disputes over the appointment of an executor, administrator, trustee or guardian.

Our lawyers provide the experience and know-how to guide our clients through this specialized, and sometimes contentious area of the law and to litigate vigorously on our client’s behalf.
