Saiber attorneys Jennine DiSomma and Vince Cirilli successfully secured a victory on behalf of our client, a private healthcare contractor, in connection with a hostile workplace environment claim brought by one of its employees.
In the case, the Plaintiff filed a complaint against our client, and various individually named defendants, alleging that defendants subjected Plaintiff to a hostile work environment on the basis of his national origin in violation of the New York State Human Rights Law and the New York City Human Rights Law. Saiber successfully obtained summary judgment, arguing that Plaintiff failed to establish a prima facie case for relief because defendants were unaware of plaintiff’s national origin and none of the purported adverse employment actions plaintiff complained of had any nexus to any protected class or activity. On appeal, the Appellate Division affirmed.
