Trusts and Estates
Saiber has an extensive trust and estates practice, assisting clients in the planning and implementation of simple and complex estates and trusts, including wills, living trusts, irrevocable life insurance trusts, family limited partnerships and limited liability companies, qualified personal residence trusts, grantor retained annuity trusts, spousal lifetime access trusts, multi-generational planning, charitable trusts and private foundations.
We analyze estate plans with a view towards implementing your personal plan and minimizing or eliminating the federal and state estate tax, federal generation-skipping transfer tax and state inheritance tax. We also review and recommend various estate planning techniques according to our clients' needs, including lifetime gifting, retirement benefits planning and estate protection. As a significant number of our clients hold interests in closely held businesses, we have substantial experience in succession planning for the continuation or sale of such businesses upon the death, disability or retirement of a shareholder or partner.
Estate Administration
Allocating a family member’s estate can be complicated as well as emotional. Our attorneys stand ready to assist you through the process, giving you peace of mind during a difficult time. We provide comprehensive estate administration services, including the probate of wills, preparation and filing of state and federal income, gift, estate, inheritance and generation-skipping transfer tax returns, preparation and settlement of executor and trustee accounts.
Our attorneys are also experienced in allocating non-probate assets, including trust assets, life insurance, real property, retirement assets, and pensions and annuities.
Fiduciary and Estate Litigation
Saiber’s fiduciary and estate litigation attorneys represent clients in a wide variety of disputes, including will contests, challenges to trust provisions, breach of fiduciary duty litigation, estate fraud, and guardianship proceedings. We offer a broad range of experience in defending complex proceedings before New Jersey’s Superior Court, Law Division, Probate Part as well as federal court. Our clients include beneficiaries and heirs, trustees, executors, administrators, and personal representatives.
