On December 3, 2015, a panel of the United States Court of Appeals for the Third Circuit ruled unanimously in favor if the firm's clients, Rutgers, the State University of New Jersey and its Robert Wood Johnson Medical School, affirming the dismissal of all of the claims asserted by a former Rutgers Medical School student, plaintiff Sarin Kadakia. Rutgers and the Medical School were represented on the appeal by Saiber partner, Sean R. Kelly.
The U.S. District Court for the District of New Jersey had previously granted summary judgment dismissing Kadakia's claims that the defendants failed to afford him adequate procedural and substantive due process when he was dismissed from the Medical School for academic reasons. In affirming that decision, the Court of Appeals held that Kadakia "was dismissed for legitimate academic reasons" and that he was "accorded far greater process than" required by law.
