On January 5, 2023, New Jersey Governor Phil Murphy signed into law an amendment to N.J.S.A. 52:27D-132 (which relates to, among other things inspections of construction projects by an enforcing agency).

The amendment provides that if an enforcing agency is requested to perform a required construction inspection but cannot do so within three business days, the agency and owner may agree to a different date and time for the inspection. However, if the agency and owner are unable to agree to a different date and time, “the owner, agent or other responsible person in charge of the work may choose to contract with a private on-site inspection agency authorized by the department [of Community Affairs] to conduct on-site inspections” to perform the requested inspection or inspections.
